SMS Terms

These SMS Terms describe the optional PIONEER HEARING AND TINNITUS text program associated with Health Notes. They supplement the Terms & Conditions and Privacy Policy. Selecting the SMS checkbox and submitting the form means you agree to these program rules.

1. What the Text Program Sends

The program may send recurring automated marketing text messages about hearing and tinnitus, healthy aging, communication, everyday wellness, clinic news, appointment opportunities, and occasional offers. SMS enrollment is optional and separate from the requested Health Notes email program. The program does not promise a fixed cadence; message frequency varies according to available updates and program activity.

2. Your Written Permission

By affirmatively selecting SMS permission and submitting your supported mobile number, you give prior express written consent for PIONEER HEARING AND TINNITUS to send the recurring marketing texts described above using automated technology, including an automatic telephone dialing system where applicable. Your consent is not a condition of purchase or of subscribing to Health Notes emails.

You must be eighteen years of age or older and authorized to consent for the number provided. No checkbox is preselected, and you may use the site without enrolling in texts.

3. Wireless Charges and Delivery Conditions

Message and data rates may apply under your wireless plan. Message frequency varies. Text service may not be available on every device, plan, or network, and delivery depends on systems outside the operator’s control. T-Mobile and other carriers are not liable for delayed or undelivered messages.

4. STOP, HELP, and Other Support

Reply STOP to unsubscribe. After a STOP request, a confirmation or legally permitted administrative message may be sent, and then marketing texts will stop unless you enroll again. Reply HELP for help. As a reasonable alternative to text commands, email support@hearingaidsoftware.com. Revocation will be processed within a reasonable period, and withdrawal does not affect messages lawfully sent before it was received.

5. The Number You Provide

You represent that the number belongs to you or that you are authorized to enroll it, that it can receive text messages, and that the information is accurate. If you change, transfer, deactivate, or relinquish the number, send STOP before doing so or promptly notify support. You are responsible for keeping the number current and for any access to messages through your device or wireless account.

6. A Strict Mobile-Data Rule

Mobile information, opt-in data, and consent will not be shared with third parties or affiliates for their marketing or promotional purposes and will not be sold. Text messaging originator opt-in data and consent will not be shared with any third parties, excluding aggregators and providers of the text message service. Those excluded messaging providers may handle the data only to deliver and support the text program. See the Privacy Policy for retention, security, rights, and request procedures.

7. Program Changes or Closure

The operator may change, suspend, or terminate the text program, message topics, or these SMS Terms where reasonably necessary for operations, compliance, or security. A material change will be communicated as required by law. Termination of the program does not erase a prior STOP or suppression record, and provisions that by their nature should survive will remain effective.

8. Idaho Rules and Program Contact

These SMS Terms are governed by Idaho law, subject to any non-waivable protections that apply where you live. The text program is operated by PIONEER HEARING AND TINNITUS LLC, 1855 Camrose St, Idaho Falls, ID 83402.
